DMCA Policy

EasyFileUpload ("we," "us," or "our") respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), we will respond promptly to claims of copyright infringement committed using our platform.

1. What is the DMCA?

The Digital Millennium Copyright Act (DMCA) is a United States copyright law that provides a process for copyright owners to request the removal of infringing material from online services. As a service provider that hosts user-uploaded content, EasyFileUpload follows the DMCA safe harbor provisions outlined in 17 U.S.C. Section 512.

2. How to Submit a DMCA Takedown Notice

If you believe that content hosted on EasyFileUpload infringes your copyright, you may submit a written takedown notice to our designated DMCA agent. Your notice must include all of the following information to be effective:

  1. A description of the copyrighted work that you claim has been infringed. If multiple copyrighted works are covered by a single notification, provide a representative list.
  2. The URL(s) or download link(s) on EasyFileUpload where the allegedly infringing material is located. Please be specific enough for us to identify and locate the content.
  3. Your full legal name, mailing address, telephone number, and email address so we can contact you.
  4. A statement that you have a good faith belief that the use of the copyrighted material is not authorized by the copyright owner, its agent, or the law.
  5. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on behalf of the copyright owner.
  6. Your physical or electronic signature (typing your full legal name is acceptable as an electronic signature).

We aim to process valid takedown notices within 24-48 hours of receipt. Incomplete notices may be returned for correction.

3. Counter-Notification Process

If you believe that content you uploaded was removed in error or is not infringing, you may submit a counter-notification. Your counter-notification must include:

  1. Identification of the material that was removed and the URL where it previously appeared.
  2. A statement under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
  3. Your full legal name, mailing address, telephone number, and email address.
  4. A statement that you consent to the jurisdiction of the federal court in your district (or, if outside the United States, the jurisdiction where EasyFileUpload operates) and that you will accept service of process from the person who submitted the original takedown notice.
  5. Your physical or electronic signature.

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the complainant does not file a court action within 10 business days, we may restore the removed content.

4. Repeat Infringer Policy

EasyFileUpload maintains a strict repeat infringer policy in accordance with the DMCA. We track copyright infringement notices associated with user accounts and IP addresses.

Our policy operates on a three-strike system:

  • First strike: The infringing content is removed and the uploader receives a warning notification.
  • Second strike: The infringing content is removed and the uploader's account is temporarily suspended for 30 days. All active uploads may be reviewed.
  • Third strike: The user's account is permanently terminated and their IP address is banned from using the platform. All associated content is removed.

We reserve the right to terminate any account at any time if we determine, in our sole discretion, that the user is a repeat infringer, regardless of the number of strikes.

5. Good Faith and Misrepresentation Warning

Please be aware that under 17 U.S.C. Section 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed by mistake, may be subject to liability for damages, including costs and attorneys' fees. Do not submit a takedown notice or counter-notification unless you are certain of your claim.

6. Proactive Content Moderation

In addition to responding to DMCA takedown notices, we employ automated systems to detect and flag potentially infringing content at the time of upload. Uploads that match patterns commonly associated with piracy or unauthorized distribution may be flagged for manual review by our team. We reserve the right to remove any content that we reasonably believe infringes copyright, even in the absence of a formal takedown notice.
