These Terms of Service ("Terms") govern your access to and use of the EasyFileUpload cloud-based file sharing SaaS platform ("Platform") operated by EasyFileUpload ("we," "us," or "our"). By using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.

1. Eligibility

You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use EasyFileUpload. By using the Platform, you represent that you meet this requirement. If you are using the Platform on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Platform

EasyFileUpload is a cloud-based SaaS platform for temporary file hosting and sharing. Files are stored for a limited duration selected by the uploader and automatically deleted after the expiry period. The Platform is available in free and paid subscription tiers with varying storage quotas and feature sets. Payments are processed by Polar.sh as our Merchant of Record, which handles tax compliance and payment processing on our behalf.

3. Accounts

You may use the Platform without an account for basic file sharing. Creating an account provides additional features including upload history, extended expiry periods, and download statistics.

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to use the Platform to:

  • Upload, store, or share content that is illegal under applicable law
  • Share content that infringes intellectual property rights, trademarks, or copyrights
  • Distribute malware, viruses, ransomware, or other malicious software
  • Share child sexual abuse material (CSAM) or content that exploits minors
  • Distribute non-consensual intimate images
  • Engage in phishing, fraud, or social engineering attacks
  • Circumvent security measures, rate limits, or storage quotas
  • Use the Platform for bulk data archival or as a primary storage solution
  • Resell or redistribute the Platform without authorization
  • Interfere with or disrupt the Platform or servers

We reserve the right to remove content and suspend or terminate accounts that violate these terms without prior notice. We cooperate with law enforcement and may report illegal content to the relevant authorities.

5. Content Ownership and Licensing

Your content: You retain all ownership rights to the files you upload. By uploading files, you grant EasyFileUpload a limited, non-exclusive license to store, process (virus scanning), and transmit the files solely for the purpose of providing the Platform. This license terminates when your files are deleted.

Content scanning: We employ automated systems to scan filenames for patterns commonly associated with piracy or copyright infringement. We do not read or analyze the contents of your uploaded files beyond automated virus scanning and filename pattern detection. You are solely responsible for the content you upload and share.

6. Privacy and Data Protection

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. We process personal data in compliance with the GDPR, CCPA, and other applicable data protection regulations.

7. Subscription Plans and Payments

Paid plans are billed monthly or annually. When you subscribe, you're agreeing to recurring charges until you cancel. You can cancel anytime from your account settings and you'll keep access through the end of what you've already paid for.

Price changes: We may change subscription prices with 30 days' advance notice. Price changes do not affect the current billing period.

8. DMCA and Copyright

We respect intellectual property rights and comply with the Digital Millennium Copyright Act (DMCA). If you believe content hosted on EasyFileUpload infringes your copyright, you may submit a takedown notice to [email protected].   • Identification of the copyrighted work
  • The URL or download link to the allegedly infringing content
  • Your contact information
  • A statement of good faith belief that the use is not authorized
  • A statement under penalty of perjury that the information is accurate
  • Your physical or electronic signature

We will promptly investigate and remove infringing content. Repeat infringers will have their accounts terminated in accordance with our three-strike policy. See our DMCA Policy for full details.

9. File Expiry and Deletion

Files are automatically and permanently deleted after the expiry period you select. Deleted files cannot be recovered. We are not responsible for data loss resulting from file expiry, account deletion, or service disruption.

You are responsible for maintaining your own copies of important files. EasyFileUpload is a temporary sharing service, not a backup or long-term storage solution.

10. API Usage

API access is available on eligible subscription plans. API usage is subject to rate limits and the same acceptable use policies as the web interface. We reserve the right to revoke API access for abuse or excessive usage. You must not share your API keys with unauthorized parties.

11. Service Availability

We strive for high availability but do not guarantee uninterrupted access to the Platform. We may perform maintenance, updates, or modifications that temporarily affect availability. We will make reasonable efforts to provide advance notice of planned downtime.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EASYFILEUPLOAD IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

IN NO EVENT SHALL EASYFILEUPLOAD BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, REVENUE, PROFITS, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify and hold harmless EasyFileUpload, its officers, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.

14. Governing Law and Disputes

These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms or the Platform shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration or in the courts of competent jurisdiction.

15. Termination

We may suspend or terminate your access to the Platform at any time, with or without cause, with or without notice. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (including Limitation of Liability, Indemnification, and Governing Law) will survive.

You may terminate your account at any time through Settings > Danger Zone. Upon account deletion, your personal data will be deleted within 30 days, and all uploaded files will be permanently removed.

16. Changes to Terms

We may update these Terms at any time. We will notify registered users of material changes via email at least 14 days before the changes take effect. The "Last updated" date at the top indicates the most recent revision. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
